PARTICIPATION LIABILITY WAIVER

Thank you for participating in the Rain City Rock Program for Girls (known as “Rain City Rock Camp” or “RCRC”) Programming (“Program(s)”). By signing this Participation Liability Waiver and Indemnification (“Waiver”), the participant above (“I”) agrees to be bound by the terms of this Waiver. The parties may execute this Waiver in any number of counterparts. Each counterpart is an original and all counterparts constitute one agreement binding both parties. Facsimile and electronic signatures will be binding for all purposes.

Follow All Rules

While participating at the Program, I agree that I will obey all applicable rules, regulations, and laws. I will also obey all rules, regulations, and policies of RCRC associated with the Program and will remain within the parameters of Program Activities (as defined below) at all times. If I violate any rules, regulations, laws, or policies, I understand that RCRC may suspend me from the Program.

I release, discharge, and otherwise agree to indemnify Rain City Rock Camp, its affiliated organizations and sponsors, its officers, directors, employees, volunteers, and agents against any claim by or on behalf of myself as a result of my participation in any program or activity sponsored, coordinated, or supervised by Rain City Rock Camp.

Assumption of Risk

I understand that attending the Program as a participant will involve activities, including but not limited to self-defense, active group games, using electrical equipment such as amplifiers, speakers, and musical instruments, moving heavy equipment and objects, screen printing, stencil making, and dancing (“Program Activities”) and that Program Activities may take place in a loud environment. I understand that attending the Program and participating in Program Activities may pose risks of bodily injury, including death, due to the inherent nature of each activity. I am solely responsible for determining whether I have adequate skills and whether I need personal protective equipment to attend the Program and participate in Program Activities. I understand the risks associated with attending the Program and participating in Program Activities, and that the risks may be caused by my own actions or inactions or the actions or inactions of others involved with the Program or the condition in which the Program or Program Activities take place. I also fully understand that there may be other risks and losses either not known to me or readily foreseeable at this time. I FULLY ACCEPT AND ASSUME ANY AND ALL RISKS AND RESPONSIBILITY FOR INJURIES (INCLUDING DEATH), LOSSES, COSTS, AND DAMAGES, regardless of severity, that I incur as a result of my attending the Program and participating in Program Activities and fully accept and assume any and all risks and responsibilities surrounding my attendance at the Program and my participation in Program Activities.

Waiver and Release

I hereby fully WAIVE AND RELINQUISH any and all claims and demands, including those for any injury (including death), losses, costs, or damages, that I may have arising out of, connected with, or in any way associated with or otherwise incidental to my attendance at the Program and my participation in Program Activities, against RCRC, including its administrators, directors, agents, officers, officials, volunteers, representatives, successors, assigns, employees, and contractors (each a “Releasee”). I hereby fully RELEASE, forever discharge, and covenant not to sue each of the Releasees from and against any and all liability, claims, and demands, including those for any injury (including death), losses, costs, or damages, that I may have arising out of, connected with, or in any way associated with or otherwise incidental to my attendance at the Program and my participation in Program Activities, including whether caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

Indemnification

I hereby agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS each of the Releasees from and against any and all liability, claims, proceedings, suits, causes, demands, or actions of any nature for any loss, liability, cost, damage, or injury (including death) to person or property, or of any other kind, whether known or unknown, including my person and my property and including claims for attorneys’ fees and costs, arising out of or related to my intentional acts or omissions or my breach of this Waiver or RCRC’s rules, policies, or Code of Conduct.

RAIN CITY ROCK CAMP VIRTUAL PROGRAM NOTICE REGARDING THE COLLECTION AND SHARING OF PERSONAL INFORMATION WITH THIRD-PARTY PLATFORMS

In connection with offering components of our Program in an online format, Rain City Rock Camp (“RCRC”) may request that participants in the program (“Participants”) utilize third-party platforms to connect with our staff and other Participants, learn, and collaborate on projects. By signing this document, you acknowledge that you have reviewed the description of information collection and sharing practices contained herein and understand that it is your responsibility to control what information you share with these platforms.

Explanation of Information Collection Practices

RCRC may use third-party platforms as follows:

Video conferencing tools, used to offer programming and instruction to multiple Participants and facilitate connections across our Program community
Music collaboration tools, used to enable Participants to work together on a particular Project
Platforms that enable the distribution of documents and facilitate written communication, including chats

Some of these platforms require Participants to create an account and login in order to use the tool. RCRC will not create accounts for any Participants and will not provide Participant names or email addresses to any third-party platform. Where an account is required, RCRC will inform Participants of the need to create their own accounts. If you have concerns about the practices associated with any third-party platform that requires registration, please contact us to discuss alternatives.

Where a platform does not require the creation of an account, the platform may nonetheless collect certain information regarding a Participant’s use of the platform, such as information about the device used to access the platform, through the use of tracking technologies such as cookies, pixels, and web beacons. Please review the privacy notices associated with these platforms to understand more about their information collection, use, and sharing practices. You may be able to exercise choice regarding the collection of information through cookies and other tracking technologies by making changes to your browser settings, or by submitting an opt-out request on the website of the third-party platform.

In the event of accident, injury, illness, incapacity, or any other medical or dental emergency, I hereby give permission for any and all medical and dental care, including hospitalization, to be administered to me (the Participant listed above) under the direction of the Rain City Rock Camp representative who bears this Medical Permission and Information Form. This permission applies whether or not the medical and dental care is covered by insurance, and I assume full responsibility for the payment of any such medical and dental care expenses regardless of whether I would have authorized such expenses under separate circumstances. Permission for Rain City Rock Camp to Use Photos, Recordings, and Statements For good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged, I grant to Rain City Rock Camp (“RCRC”) and its agents, licensees, successors, and assigns a perpetual, irrevocable, non-exclusive, royalty-free right, license, privilege, and authority to publish, disseminate, use, reproduce, prepare derivative works based on, distribute copies of, perform, and display my name, age, likeness (including without limitation photographs and video recordings), voice (including without limitation video and audio recordings), statements, artwork, zines, compositions, music, and any other creative work/expressions in connection with the execution and promotion of RCRC Program (“Program”) and for advertising, publicity, fundraising, and promotional purposes (whether or not in connection with the Program), in any manner, and in all media and formats whether now known or later developed, throughout the universe, in perpetuity, without any notice, permission, or compensation (except where prohibited by law).

PERMISSIONS FOR PRESS OUTLETS

I hereby give my permission to RCRC to (1) allow my artwork and zines to be photographed and video recorded; and (2) allow my music to be video and audio recorded. For good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged, I hereby grant to such news or press outlet and its respective affiliated companies, agents, licensees, successors, and assigns a perpetual, irrevocable, non-exclusive, royalty-free right, license, privilege, and authority to publish, disseminate, use, reproduce, prepare derivative works based on, distribute copies of, perform, and display my voice (including without limitation video and audio recordings), artwork, zines, compositions, and music for purposes of news articles about the Program or RCRC, in any manner, and in all media and formats whether now known or later developed, throughout the universe, in perpetuity, without any notice, permission, or compensation (except where prohibited by law).

Non-Disclosure Agreement

Thank you for volunteering for Rain City Rock Camp (“RCRC”). By signing this Non-Disclosure Agreement (“Agreement”), the volunteer above (“I”) agrees to be bound by the terms of this Agreement.

Confidential Information

For the purpose of this Agreement, “Confidential Information” includes, without limitation, any information, in any form, that RCRC identifies as or considers to be confidential or proprietary, and that is not publicly or generally available relating to: marketing plans, materials, or strategies; databases; designs; graphics; drawings; sketches; styles; software; employee information; personal information; individual employee compensation; financial status; contracts; owners or investors; customer information; curriculum; and any information of these types received from, about or that belongs to camp participants, volunteers, interns, or employees.

Use of Confidential Information

I agree to keep strictly confidential and not to disclose to any third party Confidential Information, or to make any use of Confidential Information except for the benefit of RCRC and in the course and scope of my participation with RCRC. I also agree not to copy, record, publish, disclose, or otherwise disseminate the Confidential Information without prior written approval of an authorized representative of RCRC, and to not use any Confidential Information for my own purposes or advantage, nor for the purposes or advantage of any other person (whether natural person or other legal entity).

Notice

If I become aware of a breach or threat of breach of Confidential Information, I shall provide written notice of such breach to RCRC so that RCRC may take appropriate measures to prevent, cure, or mitigate the breach or threatened breach.

Ownership

I do not acquire any rights, express or implied, in the Confidential Information, except for the limited use authorized by this Agreement. The Confidential Information, including all right, title and interest therein, remains the sole and exclusive property of RCRC.

Injunctive Relief

Because of the unique nature of the Confidential Information, I understand and agree that, in the event of a breach or threatened breach of any of the terms of this Agreement, RCRC may suffer irreparable harm, and that monetary damages shall be inadequate to compensate RCRC for such breach. Accordingly, I agree that RCRC will, in addition to any other legal or equitable remedies available to it, be entitled to immediate injunctive relief to enforce the terms of this Agreement.

Term

The confidentiality obligations and restrictions imposed by this Agreement shall commence at the time of initial disclosure of any Confidential Information to me and continue in perpetuity (unless applicable laws require otherwise), notwithstanding the return of the Confidential Information to RCRC.

Waiver

Any failure or delay by RCRC to exercise or partially exercise any right, power or privilege hereunder shall not be deemed a waiver of any of the rights, powers or privileges under the Agreement. No term or condition of this Agreement shall be held to be waived, modified or deleted except by a written instrument signed by the parties hereto. Waiver of any breach of any term or condition of this Agreement shall not be deemed a waiver of any prior or subsequent breach.

I understand and acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Washington. I understand and agree that if any portion of this Agreement is held invalid by a court of competent jurisdiction, the invalidity of such clause or provision will not otherwise affect the remaining provisions of this Agreement, which will continue to be enforceable. I further agree that this Agreement will be governed by the laws of the State of Washington without regard to conflicts of laws. If federal jurisdiction exists, we each consent to exclusive jurisdiction and venue in the federal courts in King County, Washington. If not, we each consent to exclusive jurisdiction and venue in the Superior Court of King County, Washington.

I understand and acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Washington. I understand and agree that if any portion of this Agreement is held invalid by a court of competent jurisdiction, the invalidity of such clause or provision will not otherwise affect the remaining provisions of this Agreement, which will continue to be enforceable. I further agree that this Agreement will be governed by the laws of the State of Washington without regard to conflicts of laws. If federal jurisdiction exists, we each consent to exclusive jurisdiction and venue in the federal courts in King County, Washington. If not, we each consent to exclusive jurisdiction and venue in the Superior Court of King County, Washington.

CODE OF CONDUCT

Our hope is that Rain City Rock Camp will be a place for Participants to make friends and find support. By signing this Code of Conduct Agreement, you agree that you will abide by the guidelines listed below while attending the Rain City Rock Camp Program (“Program”):

Always respect each other’s differences in race, ethnicity, ability, gender identity, size, sexuality, religion, politics, and economic status.
Be supportive of one another, especially with respect to individual musical abilities and creative efforts.
Be respectful of all staff members, participants, Participants, and guests.
Respect all instruments, equipment, and property. Treat them with care.
No smoking on the Camp premises.
No violence or bullying of any kind will be tolerated.
No person who has ever been convicted of sexual assault or sexual misconduct may enter the Rain City Rock Camp Program premises at any time.
