  • PARTICIPATION LIABILITY WAIVER AND INDEMNIFICATION

  • Thank you for participating in the Rain City Rock Camp for Girls (“RCRC”) Programming (“Program(s)”). By signing this Participation Liability Waiver and Indemnification (“Waiver”), the participant (and if the participant is under the age of 18, the participant’s parent or legal guardian) above (“I”) agrees to be bound by the terms of this Waiver. Parties agree to sign this document electronically.

    Follow All Rules

    While participating in Programs, I agree that I will obey all applicable rules, regulations, and laws. I will also obey all rules, regulations, and policies of RCRC associated with the Programs and will remain within the parameters of Program Activities (as defined below) at all times. If I violate any rules, regulations, laws, or policies, I understand that RCRC may suspend me from Programs.

    • I retain full supervisory responsibility for any and all activities that happen as a part of virtual programs.
    • I agree to have an adult nearby who is available during the hours of virtual programs. I will set up my child's access to the internet/virtual programs in a place other than their bedroom. 
    • I will be aware of their background and what/who is visible. I release Rain City Rock Camp from any responsibility for use of the internet outside of program channels. 
    • I agree to talk to my child about being online, such as safety, online searches, oversharing and cyberbullying.

    I release, discharge, and otherwise agree to indemnify Rain City Rock Camp, its affiliated organizations and sponsors, its officers, directors, employees, volunteers, and agents against any claim by or on behalf of myself or my minor child as a result of my child's participation in any program or activity sponsored, coordinated, or supervised by Rain City Rock Camp. 

    While participating in Programs, I agree that I will obey all applicable rules, regulations, and laws. I will also obey all rules, regulations, and policies of RCRC associated with the Programs and will remain within the parameters of Program Activities (as defined below) at all times. If I violate any rules, regulations, laws, or policies, I understand that RCRC may suspend me from the Programs.

    Assumption of Risk

    I understand that attending the Programs as a participant will involve activities, including but not limited to self-­defense, active group games, using electrical equipment such as amplifiers, speakers, and musical instruments, moving heavy equipment and objects, screen printing, stencil making, and dancing (“Program Activities”) and that Program Activities may take place in a loud environment. I understand that attending the Programs and participating in Program Activities  may pose risks of bodily injury, including death, due to the inherent nature of each activity. I am solely responsible for determining whether I have adequate skills and whether I need personal protective equipment to attend the Programs and participate in Program Activities. I understand the  risks associated with attending the Programs and participating in Program Activities, and that the risks may be caused by my own actions or inactions or the actions or inactions of others involved with the Programs or the condition in which the Programs or Program Activities take place. I also fully understand that there may be other risks and losses either not known to me or readily foreseeable at this time. I FULLY ACCEPT AND ASSUME ANY AND ALL RISKS AND RESPONSIBILITY FOR INJURIES (INCLUDING DEATH), LOSSES, COSTS, AND DAMAGES, regardless of severity, that I incur as a result of my attending the Programs and participating in Program Activities and fully accept and assume any and all risks and responsibilities surrounding my attendance at the Programs and my participation in Program Activities.

    Waiver and Release

    I hereby fully WAIVE AND RELINQUISH any and all claims and demands, including those for any injury (including death), losses, costs, or damages, that I may have arising out of, connected with, or in any way associated with or otherwise incidental to my attendance at the Programs and my participation in Program Activities, against RCRC, including its administrators, directors, agents, officers, officials, volunteers, representatives, successors, assigns, employees, and contractors (each a “Releasee”). I hereby fully RELEASE, forever discharge, and covenant not to sue each  of the Releasees from and against any and all liability, claims, and demands, including those for any injury (including death), losses, costs, or damages, that I may have arising out of, connected with, or in any way associated with or otherwise incidental to my attendance at the Programs and my participation in Program Activities, including whether caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

    Indemnification

    I hereby agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS each of the Releasees from and against any and all liability, claims, proceedings, suits, causes, demands, or actions of any nature for any loss, liability, cost, damage, or injury (including death) to person or property, or of any other kind, whether known or unknown, including my person and my property and including claims for attorneys’ fees and costs, arising out of or related to my intentional acts or omissions or my breach of this Waiver or RCRC’s rules, policies, or Code of Conduct.

  • I understand and acknowledge that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Washington. I understand and agree that if any portion of this Waiver is held invalid by a court of competent jurisdiction, the invalidity of such clause or provision will not otherwise affect the remaining provisions of this Waiver, which will continue to be enforceable. I further agree that this Waiver will be governed by the laws of the State of Washington without regard to conflicts of laws.
    I have read this Waiver, fully understand its terms, understand that I have given up substantial rights (including my right to sue) by signing it, have signed it voluntarily and freely and without any inducement or assurance of any nature, and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I understand that this Waiver binds me and my family, heirs, executors, administrators, and assigns.

  • VIRTUAL PROGRAM NOTICE

    RAIN CITY ROCK CAMP PROGRAMS: NOTICE REGARDING THE COLLECTION AND SHARING OF PERSONAL INFORMATION WITH THIRD PARTY PLATFORMS
  • In connection with offering our Programs in an online format, Rain City Rock Camp (“RCRC”)  may request that participants in the program (“Participants”) utilize third-party platforms to connect with our staff and other Participants, learn, and collaborate on projects. By signing this document, you acknowledge that you have reviewed the description of information collection and sharing practices contained herein and understand that it is your responsibility to control what information you (or your child, if you are signing this document on behalf of a Participant under 13) share with these platforms. 

    Explanation of Information Collection Practices

    RCRC may use third-party platforms as follows:

    • Video conferencing tools, used to offer programming and instruction to multiple Participants and facilitate connections across our program community
    • Music collaboration tools, used to enable Participants to work together on a particular Project
    • Platforms that enable the distribution of documents and facilitate written communication, including chats

    Some of these platforms require Participants to create an account and login in order to use the tool. RCRC will not create accounts for any Participants and will not provide Participant names or email addresses to any third-party platform. Where an account is required, RCRC will inform Participants of the need to create their own accounts. Parents/Legal Guardians are responsible for creating accounts for Participants under 13. Participants and Parents/Legal Guardians should review the privacy notices associated with third-party platforms at the time of registration to understand their information collection, use, and sharing practices. If you have concerns about the practices associated with any third-party platform that requires registration, please contact us to discuss alternatives.

    Where a platform does not require creation of an account, the platform may nonetheless collect certain information regarding a Participant’s use of the platform, such as information about the device used to access the platform, through the use of tracking technologies such as cookies, pixels, and web beacons. Please review the privacy notices associated with these platforms to understand more about their information collection, use, and sharing practices. You may be able to exercise choice regarding the collection of information through cookies and other tracking technologies by making changes to your browser settings, or by submitting an opt-out request on the website of the third-party platform.

  • I (“Participant”) acknowledge that I have reviewed the Notice Regarding the Collection and Sharing of Personal Information with Third Party Platforms. I recognize that RCRC does not control the information collection, use, and sharing practices of these platforms. I further acknowledge that it is my responsibility to review the privacy policies associated with these platforms, and to adjust my browser settings or contact the platforms directly to exercise choices regarding my personal information.

  • Permission for Rain City Rock Camp for Girls to Use Photos, Recordings, and Statements

    For good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged, I grant to Rain City Rock Camp for Girls (“RCRC”) and its agents, licensees, successors, and assigns a perpetual, irrevocable, non-­exclusive, royalty-­free right, license, privilege, and authority to publish, disseminate, use, reproduce, prepare derivative works based on, distribute copies of, perform, and display my name, age, likeness (including without limitation photographs and video recordings), voice (including without limitation video and audio recordings), statements, artwork, zines, compositions, and music in connection with the execution and promotion of RCRC Programs (“Programs”) and for advertising, publicity, fundraising, and promotional purposes (whether or not in connection with the Programs), in any manner, and in all media and formats whether now known or later developed, throughout the universe, in perpetuity, without any notice, permission, or compensation (except where prohibited by law).

  • CODE OF CONDUCT & FREEDOM OF ARTISTIC EXPRESSION

  • Code of Conduct Agreement

    In order to maintain a safe environment, everyone who attends programs at Rain City Rock Camp for Girls must read and sign the Code of Conduct Agreement. Thank you for your cooperation.

    By signing this Code of Conduct Agreement, you agree that you will abide by the guidelines listed below while attending the Rain City Rock Camp for Girls Programs (“Programs”):

    Code of Conduct

    Our hope is that Rain City Rock Camp will be a place for participants to make friends and find support. In order for Rain City Rock Camp to be safe, fun and enjoyable for everyone, here are the RCRC expectations:

    1. In Zoom, participants will use their chosen first name and pronouns in parenthesis—for example: Shay (they/them). (You might need to change your profile name once you enter the group. We’ll show you how to do this in a video leading up to the program!)
    2. Participants will only use the designated platforms to contact program staff and fellow participants during the scheduled program times.
    3. Screenshots, recording, and private, separate chats by participants are not allowed during virtual program sessions.
    4. Participant’s Zoom backgrounds will be appropriate, such as, but not limited to, a blank wall, virtual background image, or the poster provided by Rain City Rock Camp.
    5. Just like in real life, participants will be respectful during performances and workshops, and unmute themselves to ask questions when called on.
    6. Participants will immediately tell a trusted adult if ever made to feel uncomfortable.
    7. Bullying, including cyberbullying, during a session or outside of a session is not appropriate. Issues and consequences will be addressed with participant and parent including and not limited to temporary or permanent removal from the program.
    8. Alcoholic beverages, illegal drugs, smoking or tobacco products are not allowed during the hours of virtual programs. Rain City Rock Camp has the right to remove participants from the meeting without warning if staff suspects these products have been used.
    9. Sexual or suggestive behavior/comments/conversations is not appropriate or acceptable at Rain City Rock Camp.
    10. Cussing, swearing and foul language is not acceptable at Rain City Rock Camp.

    Code of Conduct addendum for those age 18 and older:

    • No adult age 18 and older who is involved with Rain City Rock Camp for Girls is allowed to date or make propositions to any minor under the age of 18 who is involved with Rain City Rock Camp for Girls.
    • No person who has ever been convicted of sexual assault or sexual misconduct may enter the Rain City Rock Camp for Girls Programs premises at any time.

    Freedom of Artistic Expression (“FAE”) Policy

    Rain City Rock Camp for Girls supports artistic expression through music, zines, art, and other forms of artistic expression in accordance with its Code of Conduct, mission, and goals. These may be found on our website www.raincityrockcamp.org and in return paperwork packets for accepted Program participants. Rain City Rock Camp for Girls does not censor lyrical and written content and artistic expression at Camp unless it is in violation of the Code of Conduct. Therefore, some lyrical and written content and art in Programs may contain issues, language, concepts, ideas, and images that may or may not be considered appropriate for all ages.

    Rain City Rock Camp for Girls Camp participants have the opportunity and freedom to express themselves in a supportive environment. It is the policy of Rain City Rock Camp for Girls to make reasonable efforts to ensure lyrics and writing are respectful, abide by its Code of Conduct, and are consistent with its mission and goals.

    Participants of all ages participate in the creation of an original song with their instrument instruction class and during band practice. Some participants, parents, or legal guardians may feel issues, language, concepts, ideas, and images arising during the process of creating a song, zine, performance, or other materials are problematic in one or more ways or forms. Rain City Rock Camp for Girls treats each of these incidents on a case by case basis. Rain City Rock Camp for Girls staff and volunteers make reasonable attempts to ensure that each participant is free to express themself in accordance with this FAE policy and that content concerns are treated respectfully.

    Participants of all ages have access to and may view or borrow music, zines, books, and magazines from Rain City Rock Camp for Girls’ lending library, some of which may contain issues, language, concepts, ideas, and images that you may not consider appropriate for all ages.

    Participants of all ages are exposed to a wide variety of music during Programs, including but not limited to during assemblies, class, visiting band performances, workshops, and band practice consistent with this FAE policy.

    Swag and gift bags may be available for participants age 12 and under and may contain an assortment of musical recordings and posters, and may or may not contain other materials, including but not limited to flyers, pictures, pins, and stickers. These items have been reasonably screened for language and artistic and thematic content. The recordings and images screened out of the swag and gift bags for participants age 12 and under are available while supplies last to parents and legal guardians who may distribute the materials to their participants if they wish.

    Rain City Rock Camp for Girls believes that the first step in increasing self-­esteem is to allow free expression. Thank you for supporting our efforts.

I understand that any violation of the guidelines in the Code of Conduct Agreement may lead to my suspension or expulsion from any of the programs at Rain City Rock Camp for Girls without a refund in tuition. In addition, I acknowledge and agree with the Freedom of Artistic Expression (“FAE”) Policy and waive any and all claims arising out of this FAE Policy and the subject matter of this FAE Policy.
